3. DEATH: Samuel McCarley states that Mary Fleming, surviving wife of said Joseph Barnett, & w/o John M. Fleming departed this life intestate in May 1869. Mary was given the Barnett homestead as her part of the Joseph Barnett Estate.
4. TEXAS COURT RECORDS: Caldwell County Deed & Probate Records; Caldwell County Tax Records.
Bk.E/Pg.275-6: I, John M. Fleming, of Bell County, Texas, did make and enter into a verbal marriage contract with my late wife, Mary Fleming, formerly Mary Barnett, in which we agreed and understood by and between us that the property owned and possessed by us at the time of our said marriage and all separate property acquired by either after said marriage should remain separate and in which the other should have no interest, and which said contract was carried out fully up to the death of said Mary, and whereas I now desire to carry out said contract in good faith, I do hereby release, convey, and deliver unto the said legatees of Joseph Barnett, dec'd., & children of the said Mary, all and singular the right, title and interest I may have in and to the real and personal property of the said Mary Fleming, dec'd., to have and to hold the same unto said legatees their heirs and assigns forever.
In testimony whereof I hereunto set my hand and seal on this the __ day of May 1871.
