In 1853, Gregory was appointed United States District Attorney for the Eastern District of Virginia, serving in that position until 1860. He thereafter served as a judge for the Sixth Judicial Circuit of Virginia, and later as the Commonwealth's Attorney for Charles City County, before his retirement in 1880.
