Services for Kenneth Wayne Futischa, 37, Oklahoma City are 2 p.m. Wednesday at the High Hill Baptist Church. Burial will be at the High Hill Cemetery.
Mr. Futischa died Sunday at an Oklahoma City hospital. He was born July 23, 1948 in Talihina to Johnson and Ella Donaghey Futischa.
He was a construction painter, a member of the Southern Baptist Church, and a graduate of Tupelo High School.
Mr. Futischa is survived by his daughter, Jessica Futischa; his son, Gabriel Futischa; his mother, Ella Futischa, and his sister, Ethel Bedell, all of Oklahoma City.
Criswell Funeral Home is in charge of arrangements.

Man Killed in Scuffle Over Gun

A man died Sunday night after being shot during a scuffle over an Oklahoma City police officer's pistol, police spokesman M.T. Berry said.
Berry said the dead man carried no identification and was listed only as a Hispanic male in his mid-20s. Police were trying to identify the man through fingerprints Sunday night.
The shooting victim was taken in critical condition by ambulance to South Community Hospital where he died about 7:45 p.m.
Mitchell Gardiner, the officer involved, was not injured. Berry said the officer was routinely relieved of field duty while the police department investigates the shooting.
The shooting occurred shortly after 5 p.m. during a manhunt along the banks of the North Canadian River west of MacArthur Blvd. as police sought two men who had been spotted about 4 p.m. breaking into a warehouse of the Chemcentral company at 7301 SW 29.
Berry said the two men fled north to the wooded riverbank between SW 29 and SW 15. Officers began searching dense brush along the riverbank on foot and periodically spotted the men, but were unable to reach them.
Berry said that shortly after 5 p.m. Gardner confronted a man matching one of the burglars'descriptions on SW 15 Street just west of MacArthur Boulevard near a cement plant.
Gardiner ordered the man to surrender, but a fight started as the officer tried to handcuff the man, Berry said. The suspect was shot once during the fight.
Gardiner was quickly taken from the scene to be interviewed at police headquarters.
"We're unsure at this point if the shooting was accidental or intentional," Berry said.
Police continued to search for the second burglary suspect Sunday night with dogs and the police helicopter.
Gardiner has been a city police officer for at least five years. In 1982, he was one of two officers who chased down and arrested without injury a bank robber armed with a pistol who held up a drive-in window of Oklahoma National Bank and Trust Company.

The police bullet that killed an Oklahoma City man Sunday night was fired accidentally says the officer involved, police spokesman M.T. Berry said Monday.
Kenneth Wayne Futischa, 37, of 1616 NW 17, died at South Community Hospital a little more that two hours after being shot during a scuffle with officer Mitchell Gardiner near SW 15 Street west of MacArthur Blvd.
The shooting occurred during a manhunt for two burglary suspects along the North Canadian River's banks. Police were searching for two men who were spotted about 4 p.m. breaking into a Chemcentral company warehouse, 7301 SW 29.
Shortly after 5 p.m. Gardiner confronted Futischa on SW 15 just west of MacArthur near a cement plant.
Berry said Gardiner ordered the man to surrender, but a fight started as Gardiner tried to handcuff the man and during the struggle the man was shot.
The medical examiner determined a single gunshot killed Futischa. Berry said the bullet entered Futischa's body on his lower right side near his back.
The shooting reportedly happened as the man turned around and began fighting Gardiner.
Gardiner was not injured. Berry said Gardiner routinely was relieved of field duty and said investigation of the shooting should take at least two more days.
Futischa was arrested in 1978 on complaints of robbery by force and fear after he and another manallegedly beat a man in downtown Oklahoma City and robbed him of $28.
Berry said Monday the second man being sought Sunday night by police had not been found.

Law Officer Returns to Duty
An Oklahoma City police officer involved in the fatal shooting Dec. 15 ofa burglary suspect was returned to field duty Monday after being cleared of wrongdoing, Police Chief Robert Wilder said.
Officer Mitchell Gardiner told investigators the fatal shooting of Kenneth Wayne Futischa, 37, of 1616 NW 17, was an accident that occurred when the man grabbed the officer's gun.
The shooting occurred during a manhunt for two burglary suspects along the wooded banks of the North Canadian River west of MacArthur Boulevard. Police were searching for two men who had been spotted about 4 p.m. breaking into a warehouse of the Chemcentral company at 7301 SW 29.
Shortly after 5 p.m. Gardner confronted Futischa on SW 15 Street just west of MacArthur. Gardiner, who was alone, ordered Futischa to surrender and tried to handcuff him.
