James J. Hale was the son of Tom Hale and Jane Law Hale and the grandson of James Law and Sarah Washburn Law. It is possible that James middle name is Jane and that he was named for his mother. The name is not proven at this time.

After the death of his parents, James lived with his aunt and uncle, Nancy Agnes Law Compton and William Compton. He is noted on the 1850 US Census in their household. He was 16 years old.

James married Susan Anna Stewart on November 29, 1851 in Marengo County, Alabama. William Compton was the bondsman.

Nanafalia Baptist Church meeting 18 November 1854, Bro. J. J. Hale applied through Bro. W. J. Compton for letters of dismission for himself and his wife, which were granted.

James, 25 and Susan, 26 are enumerated on the 1860 US Census in Choctaw County, Alabama at Thompsonville with their four children: Agnes Jane age 8, Sarah age 6, Thomas D. age 4, and James R. age 1.

James brought his family to Texas in 1866. They came with a large group of relatives, led by his uncle, Joseph E. Law. They came down the Tombigbee River to Mobile, on to New Orleans and Indianola, Texas. From there they traveled inland and eventually moved to Madisonville, Texas.

James and Susan were enumerated on the 1870 US Census for Madisonville, Madison County. In their household were children: Jane 17, James 11, Julia 8, & John 2 months. In addition was "Carlie" Roberts, 19. This was Charles Middleton Breaker Roberts who left Alabama sometime after August 1867. Charles Roberts married the Hale's daughter, Agnes in Madisonville, Texas about 1872.

The 1880 US Census for Madisonville, Madison County, Texas enumerated James and Susan with these children: Julia 18, John 10, Estelle 7, and Mattie 5.

James and Susan had a family of 8 children, 5 were born in Alabama and 3 were born in Texas. James and Susan Hale lived in Madisonville for about 30 years and then moved to Alvin, Texas, in about 1896.

James J. Hale purchased a cemetery plot before 1900. Three of his daughters are possibly buried there.

James and Susan lived in Alvin, Texas for 12 years. For a few months prior to his death, James was with his daughter, Agnes Jane, in Galveston, Texas, where he died.

According to his obituary, James was taken to Alvin and is buried in the Confederate Cemetery in Alvin, Brazoria County, Texas. James J. Hale was the owner of a Section of 8 graves in Block 1 of The Confederate Cemetery.

His obituary in The Alvin Sun Newspaper states that he was a consistent and faithful member of the Baptist church and had made many friends in the 12 years that he lived there.
